Question...

We closed on our home 12/16/2011. It was a USDA loan, not the direct.  DW is not on the loan.  But she is on some of the other non-financial paper work.  This is a new construction home.  Today I received a letter from the county informing me what my estimated tax amount will be, and it instructed me to send the letter to my mortgage company. The letter was addressed to myself and DW.

 

DW has some financial issues we are working through.  One major issue she has is with the IRS.  My question is, could the IRS possibly put a tax lien on the home if her name is tied to the county tax records. Again, she is not on the loan.

Is she on the deed?  That is what matters.

In which state are you located?

Here in Fl, if you hold the deed in both your names as Tenancy by the Entireties, then that protects the property from judgments/liens for one party only.

 

Not every state has the same thing though. You want to check with a tax professional to make sure you are holding it in the right manner.

 Mississippi is not a community property state so your spouse is not required to sign the deed.
