Quick question

Hey... My buddy needs some advice.. He and his girlfriend had a house together, purchased in 2004.. In September of 2007 they split up they did a quit claim deed and it is now solely in her name. She bought his portion of the house out and he bought another house.. He found out a few weeks ago the mortgage was never taken care of and is still in his and her name, which she hasn't paid since he left in 2007.. Is there any way for his name to be released from the mortgage, which he thought was already done when the deed was changed over. What can they do to him to collect the payments past due, if anything and how can his name still be on the mortgage but not on the deed. Thanks in advance

Re: Quick question

Unfortunately, he doesn't own the house now but is still obligated on the mortgage.  He must now have his ex girlfriend to refinance the mortgage in just her name (qualifying on her own).

Otherwise, the mortgage is still his obligation.

correct.... but some lenders will stop reporting this to you with a good explanation.
you CANNOT tell them that you refute the obligation.... just that you understand that you are obliged, however, you feel like you shouldnt be reported late unless they are communicating to you directly when it goes late.
