I'm trying to close on a home equity loan and there is an old judgement lien and lis pendin on my land records from 2006. My husband had a credit card from 2002 that went to collections and eventually they sued and got a judgement. We started paying but stopped a few years ago. The balance is around $5400. We tried to settle with them about a year ago but they wanted more than we could pay. Now that we're trying to close on this loan, we're willing to settle and pay with the proceeds of our loan but don't want to let them know we're using funds from a loan...fearful they will say we owe more because we don't have a record of previous payments. The judgement is for $8172.
What should we do...what should we tell them to get a payoff letter asap?
