We are about 30 days out from closing and my underwriter is requesting a copy of my Form 2106 from my 2014 tax return. The problem is, since the amount of unreimbursed expenses on my return was less than 2% of my AGI, the IRS does not require completion of a Form 2016 (hence, my not filing one). A simple google search showed this is a common request by lenders although it may not be legally correct (as in my case).
Has anyone here encountered this issue and if so, how was it resolved? I've considered amending my return but am hoping to avoid doing so as it isn't legally necessary.
