I just received a 1099C for cancellation of debt on an American Express CO which I paid a settlement on, and I knew that was coming, but I also received a new statement -- the first issued in several years -- asking that I pay the remaining balance by the 23rd. And they've even charged an additional $38 in interest.
It seems to me this would be illegal, but I'd like to ask the experts to weigh in. Should I file a complaint with the Consumer Financial Protection Bureau or something? This seems very shady to me.
Any input would be appreciated. Thanks.
If the 1099-C was to you the IRS should have received one too. If they issue a 1099-C they can't try to collect also. Did it come from the OC
I received the 1099 in the mail. I assume the IRS did as well. It was issued by the OC. And I made the settlement agreement with the OC and paid them directly.
They can issue the 1099-C but cannot still try to collect. You can always contact the IRS and see if they actually received one.
+1 They wrote that off their taxes, that means they got credit for it as a loss. They can't do that and collect too.
