Advice on handling Portfolio Recovery Associates?

On my 04/2013 CR from Equifax, it indicates that Portfolion Recovery associates alleges I owe about  $2175 on an HSBC account opened on 10/2008, with a date of first delinquency of 10/2007, first major delinquency of 12/2008...there is n o 81 month payment data available on the CR like all my other TLs.

First of all, the account is not familiar to me.  I honestly don't have any recollection of having this account.

Secondly, how can I possibly open an account in 2008 but have delinquency in 2007?   I think the data being reported is inaccurate.

Thirdly, I live in southern CA, and have been for well over 5 years (same address & phone--as indicated on all 3 of my CR).  I have never been contacted by mail or by an individual identified as one of their employees in any attempt to collect a debt.

So...what should I do next?   What would you guys recommend?

Can you post the TL? Date open is the date that portfolio recovery probably received the account. I would send a DV letter to them.

Re: Advice on handling Portfolio Recovery Associates?

Portfolio is the CA that is collecting on the HSBC debt.  The date opened just means the day the CA got the debt, the DOFD is the important date.  This is what sets the SOL and the CRTP of the debt.

Did you have an account that was backed by HSBC that went into arrears?  They have serviced many different CCs and other types of loans so you will have to do your research on the origination of the bill.

Send Portfolio a DV and see what they send back.

Re: Advice on handling Portfolio Recovery Associates?

Thanks for the advice.  I just mailed a letter off.  So I guess they have 30 days to respond?

Re: Advice on handling Portfolio Recovery Associates?

I also have PRA on my reports too for an old HSBC account (x2) and they have posted fake payments on my file showing as recent as 2/2013. Make sure you check all 3 CB because I hear that is a common practice for them which is a violation. There are a few people on this board that have sued PRA for the same violation and won. I've never received any letters from PRA before they started calling me. They are also notorious for sending out letters to people who they are trying to collect from, and asking for more info to be supplied to help confirm the account, DON'T fall for it!

Re: Advice on handling Portfolio Recovery Associates?

Unless you live in TX they don't have to respond at all, they just cannot continue collection activity.

Re: Advice on handling Portfolio Recovery Associates?

The TL says that your last payment as 10/2010, if this is true, you are still within SOL.

Re: Advice on handling Portfolio Recovery Associates?

I have never made a payment to them or for this account in any way.  I didn't even know this account exists until I checked my credit report.

Re: Advice on handling Portfolio Recovery Associates?

Since I haven't made a payment to them in anyway, and they have never responded to me, can I dispute this with the credit bureaus?  Or should I file a complaint with BBB?  Or should I just hang tight and wait out the 30 days since I mailed out my DV letter?
