CA offer ........need advice PLEASE

I received a dunning letter yesterday from a local collection agency. It was for a medical bill that I put off paying, let's just say I learned my lesson. Anyway, the bill was for $80 so I am ready and able to pay it. I drafted a PFD letter and prepared to send it but then I read on the forums that if you pay right after the dunning letter and before the 30 days the account will be considered PIF and won't report on my credit. 

 

Stupidly (I realize this now), I called the CA today to verify that if I pay prior to the 30 days this will just go away. I asked for the promise in writing and she said they don't send out confirmation lettters but she assured me that the account would never show up. Then she blindsided me.....

 

 

She brought up 5 other collections that have been on my husbands report for a few years. (I just filed a dispute on them a couple weeks ago. I know bad judgement on me for calling.) She gave me an offer that if I paid these other 5 accounts off within the 30 days since the dispute, they would delete from all credit bureaus. I told her that we couldn't afford to pay all 6 accounts off this month but maybe we could pay off 2 a month for 3 months. She stated that if they aren't paid off before the 30 days the offer is void. She said that she'll put a note in my file to never accept a PFD because I was already given a settlement offer and she be sure they are all added to my report since we live in a community property state. URGGG***bad word Smiley Sad 

 

So I don't know what to do. I didn't call for my husbands account information, they just volunteered it. My plan, prior to this contact, was to do PFD letters on all collections on my husbands report as we could afford to pay them. I can't afford to pay off the accounts within the next 3 weeks. I could borrow the money from my grandma and pay them off but they refuse to give me anything in writing stating all the accounts will be deleted. What should I do?

Are the collections she brought up joint?  I.E. joint credit cards?  If not, I believe she broke the law in speaking with you about them and you can sue them.

+1 - I really don't think she can give you info on your husbands accounts unless you are listed on them as well. Community property state doesn't have anything to do with bill collection, but I could be wrong.

The collections in question are medical bills. Two from our primary care provider, one from a specialist and one from a physical therapy place.

Under the FDCPA 805, Communications in Connection with Debt Collections, the term consumer includes the spouse so the CA can discuss bills with him/her.
