CRA Investigate not accurate

We are trying to repair my husband's credit report in anticipation of purchasing a new home.  We pulled all three credit reports, and sent letters asking them to investigate three old collections.  We do not know the exact DOLA on the accounts, but we are confident they are prior to 1999.  Two of the three were for the same account, even showing the same account number, one from CBUSA/Sears and the other from LVNV Funding.  TU came back and reaffirmed both of these, showing one as now satisfactory (the CBUSA) and one as correctly reporting as an adverse account (LVNV Funding).  Should we request the CRA send us whatever they got to validate the debt, or go straight to LVNV Funding?

First off, you need to do some calculating.  The DOLA is not really important for the first part of the calculation.  What you need to figure out is the DOFD--date of the first deliqency after which you didn't recover or catch up.  From there the reporting period runs 7-7.5 years.

 

The DOLA can reset the SOL in some states, but it does not impact the DOFD. 

 

The payment history in the accounts (the OCs anyway) should show you the DOFD.  You can also call the CRAs to ask about the control date--that's the DOFD.

 

Once you figure out the DOFD, then do your adding and subtracting to figure out when the reporting should have expired.  From there, you can then send another dispute to the CRAs (I would do it by mail, CM at least).  Or you can go directly to the parties who are reporting, and tell them to cease reporting.

 

The CA and the OC can both report on one account, as long as they are both reporting correctly.
