This is what the FDCPA says:
(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.
AFAIK, they can call the OC and ask them if the debt is valid and if they say yes, that is good enough. If they happen to get a copy of something they can send you that.
@guiness56 -- Thanks for the helpful information. Cavalry has just been sitting on my report. No updates, reporting, collecting, etc. I need them off one way or another. I learned my lesson jumping the gun and will be patient.
Until they validate, that is what they are supposed to do. Nothing.
Sorry, I meant they've done nothing for the last year or two. It's like they reported the baddie and never acted on it. I received one settlement offer and nothing else ever again.
Did you send them a DV then they offered you a settlement?
No, they sent the settlement a year or more ago. I never responded and there was no further contact. 30+ days ago I sent the DV. From then til now they have not done anything with the acct or attempted to collect.
LOL...see what I'm saying? How weird is that?
**Update***
Cavalry finally validated. I received a response to my DV nearly 60 days later today. I plan to respond tomorrow with a PFD. Anything else I should do or be aware of? Anyone have experience getting Cavalry to delete? I am able to PIF ($687). How much should I offer? The debt is within SOL.
I PIF with them and they deleted pretty rapidly for me. You can always try your luck at getting a settlement amount and seeing if they will delete.
