Oh dang, I just got a response from Cap one to a goodwill I sent out a few weeks ago and it sounds like this may be what they've done to mine. I put in more than one place in my letter that I was not disputing their reporting, just requesting a goodwill deletion. Their letter to me says in part:
If you still believe we've supplied incorrect information to the credit reporting agencies, please send us a copy of any documentation that supports this, such as your credit report. Please mail this information by 3/2/2012. Please understand we can't take further action until we receive this information. Once we receive it, we'll work with the credit reporting agencies to verify the information, and let you know the outcome within 30 days.
Do they even read the letters that are sent to them? Do you think they are going to put a dispute on my record? If so what affect will it have on my receiving auto financing in the next 30-60 days? How long from the date of the letter (2-1) should I wait to run my credit reports to see if they have placed a dispute? What should I do if they have? TIA!
Unlike a dispute that is filed through a CRA, a direct dispute goes directly to the creditor/debt collector. The CRA may never see it, and the furnisher may never report an actual dispute with the CRA. So it may or may not result in the posting of a dispute flag.
Since it was not actually a dispute, if they do report a dispute flag, they would then technically have to provide a dispute resolution within 30 days.
They did not dismiss the "dispute" by holding it frivolous or irrelevant, and thus reporting of a dispute would be improper on their part. Their response was pure double-talk.... invoking the direct dispute rules to ask for more information, and yet not terminating a dispute by sending a "frivolous/irrlevant" holding, as required under the rules.
Obviously this must be a form letter, but I would have much more faith in a company if they had a "goodwill" form letter that said something like "sorry Charlie, we don't do goodwill", then this nonsense double talk that leads one to wonder if they ever even actually read the letter.
I guess I'll sit tight for month and see what happens... How does it affect me in the interim?
