Case Dismissed in court

I have two companies that filed suit against me, but the courts dismissed both cases. How can I get those two accounts deleted from my credit reports?

Why would you want the accounts deleted?

Even if you did want them deleted, the simple fact the legal action was subsequently dismissed is not, in and of itself, evidence of inaccurate prior reporting to the CRA.

Unless the court held that the reason for dismissal was your showing in court that an item of information was inaccurate, I see no grounds for deletions from your CR.

THREATEN to file a complaint against them with the FTC. And if that does not work then go ahead and file it.

I've been where you are trying to go and I don't wanna go back.

What would by the specific violation of the FCRA that would warrant a complaint to the FTC?

CR drop off dates are based on accurate dates of prior delinquecies, and not upon how, if, or when the debt is paid or discharged.

I dont see an identified FCRA violation.

The FTC is toothless.  They won't act on individual complaints.

Agree totally.  Toothless by choice,  They have the authority by legislation, but dont use it for individuals.

I know of no actions taken on FTC complaints made by individuals in the last decade.

They have taken action in several high profile class action matters involving a large number of consumers, with big bucks and big publicity involved.  But not for individuals.

The FTC used to issue what are called "staff opinion letters," expressing their opinions on various FCRA and FDCPA compliance issues, but also discontinued that service more than a decade ago.

I agree that FTC complaints are not a significant way for consumer resolution of violations of the FCRA or FDCPA

What exactly is reported for these two companies on your credit reports, and how is it reported. Can you copy and paste the tradelines (minus any personally identifying information) from your credit reports?

It depends on your definition of toothless.

 

The FTC does forward all complaints to the creditor / CRA's legal department who then often contacts the consumer to conduct an investigation -- sort of like an executive consumer relations process.  This gets your issue out of the hands of the lower level front-line dweebs and into the hands of management who may just be able to assist you.

O6, I didn't realize they did anything at all with complaints.  If it gets to an Executive level then it's probably worth doing, and also if enough folks complain they might do something...

 

I actually got an opinion letter from them years ago about the phase-in of the 7 years from DOFD rule, it was very useful dealing with an Amex issue at the time.
