Chain Of Title

Does a junk debt buyer have to prove a chain of title or does the debts incurred during the last owner prove their case?  Any help, or reference any cases. Thanks

All they have to prove is that they have purchased a valid debt that is within the SOL of your state.  Basically it is up to the judge, do you have an attorney?

Is the proof you are seeking under a DV request, or  is it part of a current legal action?

 

Validation of a a DV request does not require that they prove the validity.  It requires that they conduct a reasonable investigation and make a determination supported by that investigation.  Handling of proofs are not part of the DV process.  There is no party authorized to compel disclosure, or to review evidence.

 

However, if part of a legal action, showing of title would most likely be part of their proof of legitimacy of the debt.
