I have a paid collection that is reporting on equifax and experian. I believe the date of first Deliquency is wrong. Please tell me what you think.
Date of service 11/13/2007
11/24/2007 statement states that contract for 39.00 established, first payment due 11/11/2007 I never made a payment
11/26/2007 insurance filed
2/21/2008 insurance payment received of 1803.38 by original creditor. Does this count as a payment from me?????
2/26/2008 adjustment to balance I believe this was a paperwork error - 241.88 off balance not payment from me.
3/26/2008 contract for 39.00 monthly payment terminated by hospital.
3/26/2008 contract for 662.00 payment due on 4/8/08 no payment made.
8/10/09 first paymnet to assigned collection agency, OC still owns debt,
9/7/2010 last payment made account balance 0.00
I never made a payment, hospital only received money from insurance Co. According to Equfax date of first deliquency is 9/2008.
Please tell me what you think, I would like to send a 623 to DCI credit services because I feel they are reporting wrong date.
I Want your Opinion !!!!!!! Please Help.

I don't see where 9/08 even shows on the list. Where did that come from?
I have no idea, the collection agency is reporting, not the original creditor, who never sold the debt. DCI just collected for them. I made payments to them, and they forwarded them to the Original creditor which was a hospital in ND. I don't know how they came up with this DOFD, I would think that it would be 30 days from date of service.

The insurance payment could be considered a payment on the account. It was made on your behalf. I could be wrong.
I would send the CA a dispute letter and see what happens.
I wouldn't send anything to the CRAs until you get some definite answers.
You can always call the OC and ask them about it.
Payments are immaterial unless they brought the account back into good standing prior to the collection referral.
If they sent a statement in 11/2007, it set a due date for payment of at least a certain amount. The due date of that statement, if payment was untimely of not made, would be the DOFD on the OC account.
If the account then remained delinquent up to the time it was sent to collection, the reportable DOFD would be the due date set in the 11/2007 billing statement.
It does not matter if the account was later brought back into good standing after the collection referral, or paid to the debt collector.
The DOFD controlling credit report exclusion of the collection must be prior to date they received collection authority. FCRA 623(a)(5).
The posted info showing a DOFD of 9/2008 appears incorrect.
I would send a dispute to the CRA, as they have the evidence of what was reported, and the means to reinvestigate.
Thanks for the great advice. I am anxious to get this taken care of, it might get this account deleted up to 10 months earlier then now scheduld. I have been looking at this, thinking if I was seen in 2007 how could the DOFD be at almost the end of 2008. Just to remind everyone to make sure that the DOFD sounds accurate and is accurate for that particular account.
