Not to hijack the thread - they said judgement was obtained in 2009, however I was never made aware of such a claim nor was I ever given an opportunity to plead my case. I was never sent anything in 2009 concerning this account - getting sued is a pretty big deal and I would've addressed it.
I have copies of the original judgement, writ and release of garnishment. Paycheck was garnished after the order had been released.
There is no judgement listed on any of my reports.
I've went all the way up the chain at Midland, and still do not have answers, nor the amount refunded to me that was garnished in July.
They suck.
In my experience they can't report KD as they're not a factoring company, and they're not your creditor. JDBs do this to tank your score and get you to pay - in my opinion.
I've read over the documents pertaining to that lawsuit and I took away that not only could they not collect, they couldn't report those accounts to CRAs.
But I could be mistaken.
That sounds like them. They we're reporting mine as KD on EX and EQ but it was deleted for some reason - I wasn't even disputing it at the time. It lives on on TU however.

I have printed out the filing and my assumption was no one could collect these debts? I'm also curious how they can charge interest on an account (Tribute) when the business is existent????
