Re: Collection Account

For me?

Not to hijack the thread - they said judgement was obtained in 2009, however I was never made aware of such a claim nor was I ever given an opportunity to plead my case. I was never sent anything in 2009 concerning this account - getting sued is a pretty big deal and I would've addressed it.

I have copies of the original judgement, writ and release of garnishment. Paycheck was garnished after the order had been released.

There is no judgement listed on any of my reports.

I've went all the way up the chain at Midland, and still do not have answers, nor the amount refunded to me that was garnished in July.

They suck.

Re: Collection Account

In my experience they can't report KD as they're not a factoring company, and they're not your creditor. JDBs do this to tank your score and get you to pay - in my opinion.

Re: Collection Account

He lawsuit with Compucredit, Jefferson Capital also listed others, First Bank of Delaware; which encompassed Aspire cards, Tribute and a few others. This was back in 2008.

No they never sued me or a judgment as well.

Re: Collection Account

I'm not doubting they do this to tank a score.... It's only listed on my EQ as an open account, and my score is 693. I've been denied credit when Equifax was pulled and the excuse or denial reason excessive high debt...., I've had a mortgage for 12 years never a late, and opened my first secured card back in July...

Re: Collection Account

I've read over the documents pertaining to that lawsuit and I took away that not only could they not collect, they couldn't report those accounts to CRAs.

But I could be mistaken.

Re: Collection Account

Then how or why does the CRA over look those facts?? Even when the case was disputed on BBB complaints Midland always seems to have a plausible excuse or reasoning why they are exempt.

I have printed out the filing and my assumption was no one could collect these debts? I'm also curious how they can charge interest on an account (Tribute) when the business is existent????

Re: Collection Account

That sounds like them. They we're reporting mine as KD on EX and EQ but it was deleted for some reason - I wasn't even disputing it at the time. It lives on on TU however.

Re: Collection Account

He weird thing is I'm curious if someone would have tried to collect on the debt it would have been Jefferson Capital which was on my credit report but deleted after I paid the account
