Collection Removal

If I pay the original creditor, is the collection required to be removed?

Re: Collection Removal

Not if the debt collector still has active collection authority at the time you pay the debt.

As for the "requirments," the FCRA does not require the deletion of a collection for any reason other than a showing that the debt collector did not, in fact, have any collection authortiy.  Payment status is not an issue.

The "requirments" pertaning to deletion or non-deletion of a reported collection are administrative reporting policies developed by the CRAs for thieir own business purposes.

The CRAs are in the business of selling credit histories, and want as much prior history as possbile for sale to their customers.

They thus have a policy, set forth in the standard credit reporting manual used by each of the big-3 CRAs, instructing their furnishers NOT to delete a reported collection based on the consumer having paid the debt.

The CRAs, however, do have a policy instructing deletion of a collection under the scenario where the debt collector has their collectin authority terminated PRIOR to payment of the debt.  In that situation, the creditor can reassign or sell the still delinquent debt to another, which could result in two collection simultaneously reporting on the same debt.  The CRAs thus have a policy that a debt collector who has their collection terminated while the debt remains unpaid should promtply report its deletion to the CRA,
