If account does not show DOFD and just shows date closed or date assigned is that the date used for the 7 yr count down? Will they fall off this year and next naturaully?
Two and the only two cllection accounts I have on my reports
CA = EOS CCA
Original bal $95
Current Bal $0 Paid shortly after it reported
Date assigned 5-03-07
CA = FIN Cr Netwk
Original bal = $312
Current $0 again paid after posting
Date assigned 10/2/06
Swiss
Nope, however on a good note, the DOFD can be no later than that date, and probably before it. So this is getting quite old.
Should I dispute them?
Swiss
I don't see a reason for a dispute. Is there something else that's reporting wrongly?
No, just want them gone, so they should fall off after the 7yr mark?
Swiss
Yes, but why wait? Send a round of GWs out to them.
Your credit report may not show the DOFD, but the debt collector was required under FCRA 623(a)(5) to have reported the DOFD on the OC account to the CRA within 90 days of reporting of the collection. Presuming they complied with their statutory obligation, a reported DOFD must be of record in your credit file.
Section 623(a)(5) sets forth very specific requirements for obtaining the DOFD from the OC. In a nutshell, if the OC has ever reported a DOFD to the CRA, they must report that same date. If the OC never reported a DOFD, they must contact the OC an make a reasonable attempt to get it. If they have contacted the OC but were unable to get the date, they can make their best estimate, but in no case can they report a DOFD later than the date they received collection authority.
You might try annualcreditreport.com to get the reported DOFD.
If you cannot obtain it from a credit report, you can always send a request to the CRA under FCRA 609(a)(1), which entitles a consumer to any information in their credit file.
Section 609(a)(1) requests must be accompanied by proof of identity and the current processing fee, which is $11.00
Once you have the DOFD, just add 7 years and 180 days to get the maximum exclusion date. If it continues to appear in your CR after that date, send a formal complaint to the CRA for their violation of FCRA 605(a)(4) and 605(c).
Thank you for the info..
