DV Question on Medical Debt

I want to send some DV letters to a few collection agencies in hopes of getting the negatives off of my report, but as far as I can find out online the SOL is 6 years in AZ for medical debt. The medical debt is very old, and close to six year, if not beyond. My problem is on the account it doesnt show me the date, and I dont want to send a DV letter and end up getting summoned, pay in full, and reset the 7 1/2 year mark on the debt further hurting my score when im actually trying to fix it. Any thoughts?

Hi j1901, nothing can reset the CRTP (Credit Reporting Time Period) or the DoFD. Have you pulled all 3 credit reports from www.annualcreditreport.com? EQ wil list the DoFD. TU and EX will list removal dates.

Thanks for the reply DaBears, so even if I paid in full it would still remove from the orig DOFD? I have pulled my reports from there earlier in the year, I MIGHT not have pulled EX but I will check. Also, can you or anyone confirm medical debt SOL in the state of AZ is 6 years? I see 3 and or 6 depending on if it's written or oral. One is a hospital bill and the rest are specialists from a car accident I believe. I would assume the speicalists were oral since they were aware they werent being paid at the time services were rendered as a lawsuit was pending and they were willing to wait for payment.

I was able to pull EX, it doesnt show the information im looking for, as the CA is the only one reproting the debt and one account says :

Thats from the date THEY opened the account. That account is probably from 2006/2007. With no listed removal date.

 

Two others being reported by the same CA with the exact same balance, but TWO different account numbers and reporting dates are set to fall of on 3/2014 and 7/2014. So I would calculate back 7 1/2 years from that date and assume those would be OUTSIDE of the SOL and I should be able to DV those, would you agree?

 

There is one more with a removal date of 7/2014 as well. So I would assume that would be safe to DV as well. Please correct me if I am wrong as I don't want to make the wrong decision here.

You are correct you can use the removal dates and subtract 7.5 yrs and give or take get somewhat of a DoFD You can always call the hospital or CRA's to get the DoFD. The SOL for AZ will be open or stated which is 3 yrs. Have you ever received a dunning notice from the CA?

What is a dunning notice? I dont receive much from CA's anymore but even when I did I avoided looking at it until I have recently quit hiding from these problems.

Dunning notice is a letter from the CA showing how much you owe and the original creditor is listed on there as well.

Not for any of this medical debt any time recently, otherwise I probably wouldnt send out a DV considering they had already sent me proof-ish. I guess I will get these letters written up and mailed out tomorrow. Thanks so much for your help DaBears. I really appreciate it.

Keep in mind the DV letters will probably be considered untimely, which will not invoke their reporting or collection activities.

Its worth a shot to get them removed, if not then ill think about offering a PFD. If they cant validate it they have to remove it anyways dont they? Regardless of untimely.
