I know that when you send a DV because you got one of those dunning notices that says "If you notify this office within 30 days after receiving this notice that you dispute the validity of this debt or any portion thereof, this office will obtain verification......that all collection activity is supposed to be stopped until the debt is validated. What if you DV after you have received this notice and it is past the 30 days? Does collection activity still cease until the debt is validated? I'm thinking no, but don't know for sure. And while I'm on my soapbox, it doesn't seem fair to me that we only have 30 days to send them the DV letter, but they can take as long as they want to validate it unless you are in Texas, which I am glad I am.
DVs can, and are sent, all the time past the 30-day period.
Many debt collectors will still provide the requested debt verification. So that alone is not a reason to forgo a DV.
However, once the statutory period for your request has passed, sending a DV does not invoke any cease collection bar on the debt collector.
They are free to continue debt collection. There is no provision for extension of the period.
