DV letter "is this enough or to much"

Is this letter enough or should I add something to it, I want to make sure everything on my side of this whole mess is correct.

You have recently added this debt to my credit report “Account # 5493495”. Please validate per Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) . I would also like the name and address of the original creditor.

 

If your offices have reported invalidated information to any of the three major Credit Bureau's (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws.

 

This is an attempt to correct your records, any information obtained shall be used for that purpose.

The second paragraph is untrue and needs to be removed.  3rd one just isn't necessary.  It is best to keep it short and to the point, don't quote laws, etc. 

 

They can report to the CRAs before the debt is validated.  No laws, federal at any rate, says they can't.  Your state may have something in their laws.

Yeah, they are reporting an account that was paid off 5 months ago.

Unless they have not updated to reflect it as paid, there is no requirement for them to delete just because it is paid.

I would keep only the first paragraph.

 

As to failure to have reported that the debt under collection is now $0, you can dispute teh accuracy of that informtion.

However, they would not be required to delete the reported collection based on that inaccuracy.

In any dispute, the furnisher always has the option to simply update the information so as to overcome any inaccuracy.

Deletion would only be required if they failed to update or to verify its accuracy.

So that will get the balance updated, but not compel deletion.
