I Sent a DV letter to a CA after i received a Dunning notice requesting how they came up with the amounts, and my signature that I agreed to pay them what they say. I get in teh mail a letter saying "here is the info you requested". It was a copy of the last bill from sprint, nothing else.
My question is; is this validation of the debt??
Yes. They are supposed to get verification from the OC. They only have to tell you who the OC is, and the OC address if you ask for it.
The validation comes from the OC but is sent by the CA.
In my opinion, it depends a lot on where you live!
The absence of any clear definition within the words of FDCPA 809(b) itself as to what or what is not proper validation has left it largely to the courts to determine the issue.
Federal districts, and even judges with the same district, have widely differing judicial opinions on what constitutes proper validation.
In my opinion, there is simply no clear-cut answer to this question, other than the ruling of the judge who is presented the issue.
On the bill that was sent to me, my name is nowhere to be found, its under pnmmotorsports a company that was under my wifes name, but for some reason they are trying to put it on me
Also the first letter that I received was under my name and the companys name, thats why I disputed it and asked them to send me something with my signature saying I am the responsible party
No, its not mine it belongs to the company that was under my wifes name. That is why I disputed it with them, and yeah they sent a bill, but its not under my name!
My name is nowhere on that bill!
You can do a direct dispute with the OC. Tell them it is not your account.
How can I dispute with the original creditor?
Write them. Tell them you are being asked to pay a bill that is not yours.
