US Bank is DISGUSTING.
They have a lease reporting as a collection since 2009. However, the car payments were never late and it was turned in on-time in June 2008.
However, US Bank had listed me a 120+ days late in January 2009. No CO status. Just a CA status. That's impossible, so I disputed with all 3 CRAs.
Equifax just sent me the results of the dispute. NOW I have 4 160+ lates, no CO status, CA status still applies. But now the CA status was moved from Jan 2009 to April 2009.
They did this again back in 2010 when I disputed their false claims. Are they really this daft? It's time to sue.
I'm sorry to hear about your issues with this bank. I have been fighting a big fight with them as well. It's finally starting to pay off now, keep the pressure on. If you want an idea of how little they value their customers, check out their responses to customer complaints on the bbb! Wow. After reading those I didn't even bother going that route. They shouldn't be able to treat customers this way and carry the acronym "U.S." in their name. Just sayin'.
It's a horrible bank. I'm actually shocked that only Wells Fargo and US Bank offer leases on the Tesla Model S. I'd imagine that US Bank does everything they can to "win" customers. Buyer beware!
Were you actually delinquent at those times and at that level?
They can add additional reporting of adverse information provided it is accurate.
Thus, the issue in any legal action would not be the addition of the adverse items, but rather their accuracy.
If you feel that the reporting is inaccurate and they have verified its accuracy, then you can bring legal action to compel them to produce their documentation.
Additionally, if, during the legal proceeding, you show that the reporting was inaccurate, and that they wilfully reported inaccurate informtion, you can request both actual and punitive damages under FCRA 616.
