Hi,
Original creditor in TU report shows removal date of 3/2017, but the collections company shows 5/2017. Which record should I follow? Also, when the OC neg item is excluded, will the Collections account automatically remove as well?
Thanks in advance
Negative items reported by a creditor become excluded based on the type of negative information.
If the negative item is a charge-off, and there is also a collection reported by a debt collector, then yes, they should both have the same MAXIMUM required exclusion date, as the exclusion of both a charge-off and a collection are based on the DOFD on the OC account, and have the same required exclusion date of no later than 7 years plus 180 days from the reported DOFD.
If a OC, for example, did not report a charge-off, then exclusion would only pertain to the monthly delinquencies they have reported, which do not have exclusion dates based on the same DOFD as that of any reported collection.
However, creditors and debt collectors do not determine an estimated or projected date of exclusion by the CRA.
The statute only sets the maximum date after which a derog must become excluded. The CRAs can and do choose to exclude a bit early, and their estimated exclusion dates are based on any early exclusion they choose to provide. CRAs conventionally choose to exclude at approx. 7 years from DOFD.
A one-month difference in projected dates between two CRAs is common.
