FCRA Dispute Process

For anyone seeking definative answers to the many questons about how the FCRA dispute process works, both with disputes directly to the CRAs, and those directly with an OC, I refer you the definative publication on this process, authored by no better authority than the Federal Trade Commission, in joint authorship with the Federal Reserve Board, who have oversight of the FCRA.

This report has a plethora of information, and was formally submitted to Congress in 2006 as a formal submission by the FTC and FRB pursuant to FACTA 313(b).

It is titled the "Report to Congress on the Fair Credit Reporting Act Dispute Process,"  dated August, 2006.

This is not just a publication of one-sided opinions offered by consumer advocates or the credit industry.  It is an evaluation of both their positions, with opinions on each offered by the federal regulators of the industry,. As such, the opinions are watered down, but it offers a great overview of the process as it really is.

To get it, just Google on FRB Report to Congress on the Fair Credit Reporting Act.

It was also initially published as a Notice of Study in the Federal Register at Fed. Reg. Vol. 69, No. 153, August 10, 2004.

Re: FCRA Dispute Process

I love this line:

"They believe that CRAs and furnishers have little incentive to conduct thorough reinvestigations because such investigations are expensive and the relatively small number of lawsuits that CRAs and furnishers face for failing to conduct adequate investigations impose almost no economic cost"
