FUNANC/ GEMB & Conseco are BOTH reporting but dates all wrong

Ok, I know I'm going to get blasted by everyone that one can report when it is the OC and they have CA doing the collections. The CA has wrong information and I am sure the DOLD is over their limit to report? Basically, the OC has the correct information and the CA is wrong. I have the feeling I will have to PFD in any case but I do not know if it better to Dispute the CA or PFD the OC? I just want to make sure that the end result is a clear report.

The OC can report for 7 years AFTER the last baddie -- for example, if this was a charge off in 06/03, then it will stay on your CR until 06/11.  It will probably fall off the last day of the month (June 2011).

 

The CA can report for 7 years AFTER the last baddie - for example, if this was a charge off in 06/03, then it will stay on your CR until 06/11.  If the CA bought it in 07/03, then it may report an open date of 07/03 (when it was purchased by them).   The end date/fall off date should be the same -- 06/03.   It's approximately 7 years after the DOFD.

 

If you had a late on the account in 01/03, and it reported/updated on the CR in 02/03, then the clock starts ticking for THAT offense to fall off in 02/03 (fall off 02/11).

If you had a late on the account in 02/03, and it reported/updated on the CR in 03/03, then the clock starts ticking for THAT offense to fall off in 03/03 (fall off 03/11).

You can always ask for PFD.  

 

They can accept, or deny, the request.

 

If you owe the money, you should pay it off.

 

Many people would advise you to know the SOL and the DOLD BEFORE you make any offers/contact.   

 

- can you pay in full?

- is it past SOL?

- what is the DOLD?

This account is so old that honestly don't remember the DOFD. Where can I get that without triggering some CA response? I actually sent a DV to the CA (NOT the OC ) and I haven't got a response since 8/17/2010.

The CA may need more time to pull the documentation together.  Chances are, if they respond to the DV with information, the DOFD or DOLA will be included.

 

Sit tight and work out a budget so you can pay them.  Smiley Happy   They have to cease collections efforts until they supply the DV information.

 

PS -- ANY chance of you finding ANYTHING that would indicate when last activity was?

i THINK I may have found something but it was back in the 2004. My wife keeps meticulous records now I am grateful for that. that amount was $2000, they are reporting $11500! So I can only imagine where they even got that number from.

Another suggestion is to routinely pull your CR and keep copies of them!!!   It could be a tool in the future against CA not so good book keeping.  Smiley Happy
