Factoring Company added to my report!!!Help!!!

So, I have a capital one charge off from 7/2006. All of a sudden there was CVF Consumer Aquisitions added on to my report. I never received any mailed notification from them. I submitted a dispute on Equifax requesting them to delete, as it is past SOL. Well it came back saying that they have verified and it is showing on my accounts and 120+ days late. What do I do?

As for the charge off - it may  be past SOL, but can report up to 7 - 7.5 yrs past DOFD.   If the charge off was 07/2006, then it would likely stay on your CR until 08/2013 or so.

I just disputed lvnv funding (factoring companies) on Equifax and last activity was Nov 2006, balanc 0 and I disputed SOL and current status reflecting 120 days past due and it was deleted from my report today!  Go figure!!!

The debt collector was required to have sent you dunning notice, identifying themselves and the current credtior, and advising you of your DV rights, within 5 days of reporting to the CRA, so they are now apparently in violation of FDCPA 809(a).

If you have their name and address, send them an immediate DV letter.  That will require them to cease collection activity until they provide you verification of the debt. You dont have to wait for dunning notice to DV them.

I am not sure what you cited as the inaccuracy in the reporting of the collection when you disputed other than alleged expiration of your state SOL.  As has been stated, status of your SOL is irrelevant to credit reporting or CR exclusion, so it appears that verification of accuracy was a proper finding in the dispute.

Any violation of the FDCPA by failure to provide dunning notice is not a disputable inaccuracy of credit reporting, so dont file another dispute over that issue.

If you have reasons for asserting the reporting of the collection was improper, you can send a direct dispute to the debt collector.   I dont see any reasons in your post for inaccuracy, but dont know what other issues you may have.

The 120 late is reporting by the creditor, and not an issue with the debt collector.
