First Premier Option/Advice....Help with plan of action

Okay so I am so close to getting the last two baddies of which is First Premier back in 2007 I remember being pre-appoved etc.. but I then moved to New jersey and some crap about if you move to NJ it activates the card etcc.... ok so of course all these fees were tacked on and we know the rest. Now I lived in NY at the time. I have been doing some searches and saw that there was a lawsuit against FP in NY about there lending practices. I called them up to see who has the debt they said that they still have the debt, but I remeber receiving a letter in the mail from Jeffersons Capital about a fresh start program Smiley Indifferent I never responded becasue there was other things I was woking on and wanted to deal with FP last since they are the hardest. Here is how they are reporting on Myfico under my old married name and an incorrect address:

So my questions is how do I attack this? Do I use the NY lawsuit as grounds for removal? State this isn't mine? Get it removed on the grounds that it is reporting different and inaccurate across all three credit bureaus, (623) dispute with the credit bureaus directly. Disputing with them directly they want me to fill out an affidavit and police report. (I don't want to do that if I really do have an account with them) this was over 7 years ago so I do not remember. Or do I wait till they fall off? I don't want to wait either I would like it clean by december. Pls Help any advice would be helpful. Thanks in advance Smiley Happy

 I would recommend sending them a direct dispute to place on record your assetion to them that you dont have a legit account, and to get their investigation and response.

 

You may very well receive a verification of accuracy of their reporting, which would be adequate response to your dispute.

Neither the direct nor the FCRA dispute process requires them to document or prove their finding of verification, but you at least take the necessary step of first disputing the accuracy.

 

Next step will be to contest the actual facts.

Two ways appear to be appropriate.

If there is clear case law applicable to your situation, you could handle by way of complaint to the CFPB, asserting their continuance of an improper acts.

If the facts may need some interpretation of additional evidence, that is wha the courts are for.  Consider bringing civil action to get the matter resolved.

Research the 2008 FTC suit against FP's parent company, Compucredit for their shady marketing practices. I believe it just this sort of thing the suit was all about.

A direct dispute with the creditor as allowed under section 623 of the FCRA.
