Did you actually file a direct dispute with them, identified as such?

If so, they either had to formally investigate the dispute and report their findings back to you, or else if they considered it to be substantially the same as a prior dispute, send you a formal notice of lack of investigation of the dispute as being "frivolous or irrelevant." Dismissal as frivoulous or irrelevant must be concluded within the investigation period along with an explantion of what they found lacking, or that they consider it to be "substantially the same" as a prior, completed dispute.  Do you have a prior completed dispute?

 

If you filed a direct dispute, it is not a proper investigation or termination of the dispute under the provisions of 16 CFR 660.4. 

If it was just a request, they could treat it as they please.
