I know that charge offs usually stay on your report for 7 years + 180 days, but I have also heard that in NY state, it is limited to 5 years.
I had a chargeoff of a Sears card 5 years ago. I opened the account in NY state and it got charged off while I was in NY state. Shortly thereafter, I moved to Virginia and payed the chargeoff in full. I wish I would have known what pay for delete was back then, but I didn't.
Should this come off my report in 5 years, or the standard 7 + 180 days?
If you are currently still living in Virginia then the NYS 5 year rule no longer applies to you, unless you move back to NYS!! But if you move again (out of NYS) then it can be re-reported!
Ok, thanks for the responses. My parents still live in NY, could I use their address for correspondence? If not, should I try goodwill removal letters? I tried calling once and it didnt work.
At this point I believe that you should start sending GW letters! Trying to say you still live in NY by using your parents address, I just don't think is going to fly!
