Getting false inquires removed.

I had pulled my experian report a couple months ago. It was by far my cleanest so i've been focusing on Eq and Tu.

 

I just went and checked it again through a loophole with quizzle and its showing quite a few hard inquiries that are false that all popped up since the last time. I had about 4 different inquiries 1 month apart all by General Revenue Corp.

 

I called them and they don't have any accounts under my name nor should I have any vailid debts taht are still outstanding either reportable or not...

 

So why are they HPing me?! They told me that they would only pull one's credit report if they had a valid claim with them and thus with that logic I'm clearly mis-understood and they didn't HP me at all let alone 4 times in a row on a monthly basis.

 

They are all within 6 months old, not valid, and really pissing me off as I was getting ready to app for a non cap 1 card come early December. All my other inquires on that report are valid and beyond the 1 year mark.

 

How can I get these removed? General Revenue Corp said they never HP'd me since I didn't have an account with them.

 

Any help? I know the CRB just usually say "well they pulled it so it must be valid"

Send a ceritied letter to the CEO/President stating your concerns and even include a copy of the HP's and ask that they retract the pulls. If it was a HP, I would think there would have to be a trail as to why.

 

I would also get a BBB complaint started with this same information. Compaines tend to respond to BBB complaints a little differently.

Is there any sort of legal ramifications I can take in regards to this? Not only did they pull my credit report mutliple times they pulled it without any reason - I did not request credit from them, I did not do business with them, and they did not give me any firm offers. Didn't I read somehwere that they could be held liable for damages due to false inquiries?

 

I don't want to take the time to go to court, but if I can put in the letter "for each infraction its $_____ and I may be inclined to exercise my rights if this is not resolved in 15 days" sort of thing; I'm sure I would see a speedier compliance rather than just saying "please remove them as your killing my chances of an app right now"

This was a letter by Tuscani.   I don't know all that lawyer talk but maybe it will be helpful.

As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law (Fair Credit Reporting Act -- 15 USC § 1681n(a)(1)(B) for an entity to view a consumer’s credit report without a "permissible purpose," I am writing to inquire as to your alleged purpose for doing so since I did not apply for employment with your organization nor did I request credit from your organization.
 
[Describe any additional details about the inquiry here if need be. For example, your a subscriber to XXXX monitoring service and XXXX company pulled a "hard inquiry" on one of your reports.]
 
Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC §1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"
 
You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.

Thanks for the letter...

 

Man for 1k a pop, maybe I should consider the court route if they don't take them down in a timely fashion (assuming it is 1k per pull not per report).

 

I'll be sending that out today.
