at no point did i say the FCRA imposed anything related to the SOL.

 

We do not know what state he lives in therefore we have no idea if the SOL is even in play. But he will.

 

what we do know is that an account appeared that had popped on and off the report under discussion.

 

the indicators of aging include very specifically that behavior.

 

That you and Rm seem to want to convince him to ignore that avenue of investigation is bizarre beyond belief.

 

It is one of the many things he SHOULD do to make sure it is not happening. If it isn't he has checked that off the list, if it is he has an actionable cause to bring to court.

 

You may be an Epic Contributor and Community Leader in your profile but that does not mean you get to try and convince people to not follow every viable path to understanding the problem they face.

 

You are not omniscient, you know no more about his situation than any one else here. and it is beyond belief that you would try to dismiss a real and prosecutable reality that is common with debt buyers trying to collect their debt.

 

If that account is aged the CRA MUST remove it. The only way to know that is to investigate and ask the right questions.

If you do not know the right questions you will not ask them and Debt Buyers and CA's rely on most people not knowing the right questions and the laws.

 

If you want to argue about the practice and how common it is, argue with all the lawyers at NOLO.COM and every firm in the nation that makes money suing debt buyers and collection agencies for bad practices.

 

In the meantime stop trying to dismiss a necessary step to make sure he is not being screwed over.

A wise man once said a little bit of knowledge is a dangerous thing. If the OP's collection does not have a DOFD older than seven years then there is no reason for it to be removed from his report. The OP stated that it had come off his report before and that it was under another CA name this would make sense, if the previous CA no longer had collection authority then they would be required to remove there collection and the new CA could then add theirs to OP's report. As previously posted "IF they bought it and the original debt is past the SOL, dispute it as such." what would he dispute the only thing that is disputable is the accuracy of the information. If any information is inaccurate then the CA would be required to correct any errors but they would not be required to remove the collection provide the debt was theOP's.  Robert knowledge of the FCRA unquestionable,  I would never doubt his advise in such matters.  OP do you have a copy of your complete credit report (meaning one from the CRA's themselves not CCT or MYFICO) and does it show the DOFD?  This will tell you if you can request it be removed due to its age.  Even the link provided h ttp://www.nolo.com/legal-encyclopedia/debt-buyers-your-credit-report.html

states " The FCRA limits the amount of time that negative information can appear on your credit report. Generally, a delinquent account can show up on your credit report for up to seven years from the time your first delinquent payment was originally due on the account."
