I definitely was not properly served, its for that reason my lawyer was able to reopen the judgment against me, usually if you have a judgment it's pretty permanent and cannot be disputed.  But since I was never aware of the court date, I never got my date in court.  Thank you again for all of your help. 


 

If your lawyer had the judgment "reopened", why wasn't it vacated?

Thanks to all of you so much.  I will go to obtain any further documentation and file a police report, i'll file the motion to vacate and hopefully get this taken care of.  This really gave me so much direction, thanks.  I feel like I kept hitting dead ends, and paying every time I breathed near my lawyer (but got few answers and little progress)

Something here is confusing.  You mentioned that your lawyer had the judgment "re-opened" and then you just mentioned you will file a motion to vacate the judgment.  If the judgment was re-opened, then it would have been vacated if the judge thought there was grounds to do so.

It was a complaint to reopen the default judgment against me so that I can dispute it.  Not because it had been dismissed, but because it couldn't be disputed after getting the default.

So that means after the case was placed back in the calendar the judge wants a hearing to actually look into why the judgment should be vacated.  Sometimes you file the motion and the judge will just vacate the judgment without any further hassle, but sometimes there has to be a hearing.
