Hunter Warfield Ruined My Credit

I need some advise here. I am dealing with these people for TWO accounts!!!!!! Basically, I have been in contact with these vultures on one account for going on two years and another account for a few months. I contacted them and explained the situation to them, that their clients in fact violated their own leases. They then asked for proof and I sent them a copy of the lease, highlighted the section showing where their clients violated the lease, provided a police report, cell records, and witnesses to verify my story. At that point they disappeared.

The second case I am involved with them I lived at an apartment where my lease ended in April. I extended it for 3 more months with the intention to move out 7/30. I was told I needed to give 60 day notice. I explained I am building a house so it would be ready sometime around 7/30. They accepted this and told me I could go "month to month" without a lease or sign a 3 month lease and move out at the end of the lease or go "month to month". During this time I found out due to incliment weather that my construction would be backed up until August 25th. I called the office an told them I'd need an extension to move out. They told me no problem that everything would be fine. Well when I moved out they explained that once I told them I needed an extra month the 60 day clock reset. How can that be legal? There was no contract or lease signed, my lease legally ended on 07/23/2015 meaning when I moved out on 08/30/2015 I was well within my 60 day notice period because I actually added an extra month due to the extended construction. They then expalined they dont do month to month leases that all of their apartments are month to month with a 60 day notice. I said so basically you only offer 3 month leases. She said no its month to month. I again reminded her that month to month is exactly that, month to month, thats why you spend more money. They then turned me over to these vultures. I called them, provided them with the proof. They disappeared for a few months. I sent them multiple emails trying to contact them and receieved zero response. 

 

They reported me to collections. My 768 is now a 625. Destroyed me right as I was refinancing my house and student loans. Now I am ruined after spending years rebuilding my credit.

Wow, just wow. Not sure if it's legal or not but that sounds like a scummy move. Hope someone can help you out.

I've NEVER heard of a rental requiring a 60 day notice. Check your states laws to find out if thats even legal.

I agree, but regardless, they could have a trillion day notice. I never signed a contract or a lease, and I was well with that time period when my lease ended.

Look up:

195 Civil Code Section 1946.1(e).

 

Consult a lawyer about the legality of what they did. If it is indeed illegal send them a ITS letter if they do not quash the collection.
