ID Theft Nightmare

Hi all...I'm new to the board here...but read this site like it was part of living!! I think I am obsessed... Anywho..here's the skinny.. been fighting ID theft for 6 years. Someone had car loans, bank accounts, credit cards, payday loans, and the kicker-their appendix removed. I have finally after years of fighting gotten everything taken care of but the surgery item. I am beyond frustrated with this one. I have ID theft affidavits, from the beginning, from when the FTC form was one wanky piece of paper, and i have updated it regularly...but i digress... i sent CMRR the id theft info, police report etc to the collection agent for above mentioned surgery. they wrote back they 'think' it is me. i played harder ball. sent in the fraud blocking request and the entire package of docs again. this time, the collection lady (who has referred to herself as 'god of her department') wrote to me stating "i have reviewed your file, and you checked into XXX hospital on XXX day, to have your appendix removed, and were told your insurance was not valid at XXX hospital, so you agreed to the hospital payment plan" further down in the letter it states 'we have reviewed your documents, and in our opinion believe this is YOU and your debt'.... with that being said...what do i do now??? a) they have told me the person who had surgery is named TIM...i am a GIRL. b) didnt they violate someones rights telling me the med history? c) they told me the persons blood type in another letter --NOT my blood type... i just dont know where to go. i've filed FTC complaint. Texas attny general complaint , BBB complaint ...heck i've complained to my senator..... this stupid thing is the only thing that is left from the ID theft and i am obsessed and losing sleep. its 21,000 showing as 1 month payment. OH and the SOL is up on it so why are they being so pigheaded??? i followed the rules, sent in everything....is there anything that i can do now? on a good note. when i started the 'i'm going to go bonkers' mission in august, on the 4th, my FICO was 510, 501 and 507 right now as of today they are at 650, 635 and 630 so i have made progres.... i just dont know if i should give up and move on or what! oh great wise FICOforum guru's any help is appreciated.

What I think you need to do, is get a written document from your doctor that you are in fact a female, listing your blood type and that you still have your appendix (if you do) and if you don't then send them the documentation of the real appendix removal lol they cant remove one twice lol.


then get it approved by the police and added to the police report if you can.


any other suggestions?

Honestly, the stubborn pig-pigheadedness of collectors is just amazing. Smiley Mad Please do realize that the goddess you spoke with doesn't give a rat's patootie at this point whether this is a valid collection; she just wants her cut.

thanks for the help....i should add, i DID go for a body scan, two years ago, my insurance wouldnt pay for it, so out of pocket i paid for it. i can prove i have girl parts, i can prove i have my appendix, i have a doctors sworn affidavit that i have all my parts, that i never had surgery, that my ummm upper girl parts are real also, what my blood type is, all the way down to the RH factor in my blood. the doctor also wrote stating that i have GIVEN BIRTH!!! so umm that makes me pretty much a girl i think??? dunno...maybe i live on another planet..... anyhow....i could have sworn they have to honor my fraud block? at least i thought. and dont they have to prove the debt, not me prove its not???? they wont give me anything in writing other than these stupid letters that keep on saying 'in our opinion it is valid and your debt'. i asked for all copies of docs etc and get nothing. four years of this!!!!! FOUR!!!!! thanks for listenting all..........i sometimes feel like this is the only place that gets how frustrating this can all be. oh and by the way, i got two checks so far for 1000 each. i had pulls on my credit from places that couldnt prove it was valid, i believe they were part of the grand ID theft stuff, but anyhow...i wrote, they didnt remove, i wrote again, didnt remove, so i sent a letter with a bill for 1000 stating if they didnt remove it i would sue. it was a bit more wordy than that but you get the idea. and two ppl actually sent me a check, and a week later removed. .....seems like they coulda just removed and saved themselves money but oh well!

Personally, I would take the $2K and hire a lawyer to teach that hospital the difference between a woman-who's-given-birth-to-a-child-and-has-an-appendix and a man-without-an-appendix.

Or conversely, you could always use the $$ to take a trip to the moronic hospital and compare medical records. Maybe "flash" a doctor or two, if that helps (sorry being smart-mouthy -- but really, the hospital deserves it!!).

But mainly, I'd threaten a lawsuit, toute d'suite. An ugly, media-w*oring, bad-publicity-mongering lawsuit. I mean, do you realize how STUPID this makes that hospital look -- that they can't tell the difference between a man and a woman???!!!

Um ... no matter how desperate I was, I'd not even go there for a paper-cut. o_O
