I see two different issues.  One, possible responsibility for the debt, and two, the legitimacy of any credit reporting made based on such a responsibility.

 

I agree with the comments regarding community property, which go the ultimate issue of possible legal obligation for a spouse on debt incurred prior to marriange.

However, it is not uncommon for a creditor/debt collector to report an asserted debt obligation on the credit report of the spouse.  It may be totally improper if not community property and/or not a joint account, but that does not mean they wont do it. 

You then have an FCRA/FTC/legal issue to unravel and show they are incorrect.

 

I think the advice to be wary has some merit.  Being correct on the matter does not mean that it wont arise.
