Identity Theft Question

Inspired by my rebuilding journey, my best friend decided to pull her CR.  She found $13,000 installment (current) that she knows nothing about as well as a $1300 revolving debt (also current).  Because the TLs are current and never late, she believes a family member used her identity to obtain these things. She does not have any credit cards or debt other than student loans, which are reporting correctly.  What does she need to do to get these off?

She needs to fill out a fraud affadavit and send it in.

The FCRA provdes that if a consumer files an "identity theft" (police) report asserting that they never authorized any transactions related to the account(s), and sends a copy of that report to the CRA, the CRA is bound to immediately block that information from any subsequent credit reports they issue.  No "prooofs" of actual identity theft, or how it may have occured, are required to be established by the consumer to obtain CR blockage.  FCRA 605B.

 

So CR blockage can be obtained by filing a police report, and sending it to the CRAs.

However, the police report itself may be investigated by law enforcement, so it could set it motion potential action against the thief.

When filing the report, you subject yourself to potential criminal sanction for any knowling false statements you make in the report.

Law enforcement is likely, upon receiving an assertion of identity theft, ask you if you have any information as to the responsble party.

If a famly member is the suspected party, that brings ihto play a potential dilemma.....
