I submitted a complaint through BBB to get a JCpenny charge off removed. They ended up removing the charge off due to the address being incorrect. They basically stated that they are removing the chargeoff due to the incorrect address as it is possible that I may not have been receiving my billing statements. So if that is the case can i I use that to possibly get the Calvary collection removed? The collection has been paid but I just want it gone.
Are you willing to go before a judge and assert that you were not aware of a delinquent debt?
A finding by the OC doesnt carry over to the debt collector each of these entities is in control of their own TLs. A goodwill letter to th CA would be the way to go asking for removal of their TL. You could make an argument that you were not receiving your statements as you did with the OC and then it would be up to them to allow it or not.
I doubt the CA will remove the account for that. Just like someone said previously, the GW letter may be your best bet. The response generally given to "I never received my statements" is questioning how someone can be using a credit card or know they have a balance and not pay it, just because they did not receive any mail. To the best of my knowledge, I have not read on this forum where that was an acceptable reason for a CA to remove the account (even if it worked with the OC). However, stranger things have happened.
My personal opinion is that CAs hear excuses all the time and this would be no different. Your best approach may be to own up to your mistake and just be nice to the person on the phone. That has worked for me in the past.
