I had an old Providian Account that I was delinquent on. I paid it off to Presidio (2007). They did not send me a PIF, but I demanded it. I received a PIF from Enhanced Recovery 4 months after I paid off the debt (2008)
I received a judgment summons this year to go to court in July to Midland Credit. It was the Providian account! I have faxed the PIF information to the lawyer and am waiting a response.
do I have any other actions I can take against Midland Credit? It's very frustrating to have paid off a debt and to have it keep rearing up like this.
Be sure that you go to court, or verify with the court that the case has been withdrawn. I think that's the likely result of your contact with the attorney. If you deal with the court directly (which you probably should, instead of relying on opposing counsel), make sure you get the case dismissed with prejudice, so they can't file again.
You can file complaints with BBB, FTC, and your state AG against Presidio, ER, and MC. Maybe Providian too.
For good measure, file a complaint against with the state bar association against the attorney (after this is all over). That will make the attorney have to explain himself to someone.
What a mess. Very sloppy.
