Hi all. I've been perusing the forum for awhile and need some advice.
First, thank you all for the wealth of information here. It's been beneficial.
I have two judgments filed in TN. One is Cap1 for $1500 for a $500 cc. DOFD was 2008. Judgment filed in 2011. No action appears to have ever been taken on it. The other is a repo turned judgment, also in 2011. Judge ruled I was responsible for it at the same high interest I was paying on the loan. So it's been collecting close to 8 or 9% for 5 years while I was in school. However, no action has been taken on this either.
Could be due to a Trust Fund Recovery Tax Lien on me. Or the fact that, until recently, I was in school. I now have a job and am working on rebuilding my credit.
As of this weekend, I have a Discover IT ($1000), Cabelas (SL u/k), Amazon ($1000), Overstock (800), Walmart (600), Lane Bryant (300), TJ MAxx (250), and JCP (100 hahahaha). I also have a CareCredit card that's several months old with $1700 CL.
My concern last night was realizing I need to be very worried about a garnishment on both of these. The tax lien is still there but will go away later this year. I'd like to be realistic and settle these both but I don't know what kind of 'settlement' to ask for in either one. I also don't know if what I read online is true...for either company to collect, they would have to establish the judgment in OR before being able to garnish me. True?
Any advice you all can give would be helpful. This has me very worried as I cannot afford to lose 25% of my paycheck. And my job is salaried but I work 80hr/week sometimes so time for a 2nd job is lean.

What do you mean "no action has been taken", like you haven't been sued?
Have you received some kind of formal letter that you will be garnished?
What do you mean you don't know what kind of settlement to ask for? Are you saying you're not sure if you should dispute, or you're not sure of the amount to offer?
I'm assuming I was sued as there is a judgment on file for the credit card. I was sued for the car but showed up without a lawyer and things did NOT go well for me.
"No action taken" = I haven't been garnished and I haven't heard from the creditors. I haven't received any information of garnishment--just worried I will.
The car one gets me riled because I'd set up a payment plan but there was no record of it once it got to court. Regardless, I'd like to consider a way to settle both of these.
Hopefully that answers the questions. Sorry for the ambiguity.

In order for them to seize assets or garnish wages, yes they must first "domesticate" the judgment to a court in your current state of residence. HOWEVER - if your bank has a presence in Tenessee, any assets in that bank are at risk. I would also "cleanse" my reports of my current employer, as well as old addresses...
Oh!!! Thank you! I didn't think about the bank side of things. Gives me a good reason to find one here. Especially as the one I use from TN actually isn't in a tristate area here. Working on cleaning my report, typing things up, and getting them all printed. Hopefully, I'll get it sent the next few days.

I'm in OR as well - I bank with the Bank of Eastern Oregon - I highly recommend them if you are near a branch.
Getting a judgment from another state domesticted in your current state of residence is not a big deal, and could readily be obtained.
How long does it remain enforceable in TN?
Hello, so my situation may be a little different from your's, but not much! I have two judgements, one from 2011 and one from 2008. My judgements were both done through courts in New Jersey, in fact I never even got the paperwork that I was being sued, because I had already moved to Florida. In November of 2015 I went and bought a car, so my job came up on my credit report. About two months I got an email from payroll at work letting me starting the following paycheck I would be garnished, 10% of my gross pay. I don't think in any state they would need a seperate judgement to go after your pay. I also read recently that they can freeze your bank account. I'm hoping this isn't true because I still owe one! Hope everything works out for you!
Just read some of the other comments on your post and am thinking that maybe the fact that my company is national and based out of Pennsylvania has something to do with them not suing me in Florida... it's a possiblity!
JerseyJess, not to be intrusive, but are you married, or single?
You might want to take a good hard look at Florida's laws as far as garnishments, and judgement collections goes. It's one of the harder states for a creditor to collect in, as far as I know
