Looking for quick input on Charge off

Capital one did a Charge off and still shows the balance, they also did a judgemt and balance shows.

Is this normal?

I just thought it was odd but wanted to double check.

This is something that drives me nuts.  When an OC sells off an account, it should report as -0-.  I've read conflicting statements to that effect.  In my instance, my charge off was sold and reports as -0-.  My husbands is reporting as to what the account sold off to...and I'm fighting that as it's killing utilization.

Where does it say they sold the account?  Just because they did a CO does not mean it was sold.

If Cap one still owns the account, CO or not, it can show the balance.  The judgment would have nothing to do with it.

hmmm good point! But it is dinging my UTIL with it not showing 0. So looking over the judgement for cap1, if I agree to pay if they agree to vacate can I ask that the entire TL also be removed from my CR?

Yes, it will hurt your utilization until paid.

Yes, you could ask for it to be removed as a term of paying the judgment.  How old is the judgment?

I would worry about them getting a garnishment order also.  If your state allows wage garnishment.

It was filed under my maiden name and on the front sheet where it says

On this___ day of___,20__ at

oclock___ AM__  PM___ I have duly sereved the foregoing Summons

None of that information if filled out

Where did it come from?  Were you served?

Well sort of!!  A lady stopped by my house and asked if was ***( first name only) and I said yes and she handed me papers and left.

Address on them is for another house I lived at so the must have told her where to find me :-)

Have you contacted the courthouse?  I would, ASAP.

If there is nothing on the paperwork how would you know when to show up in court.  If that happened, they would win by default.

Well since it was 2011 I am sure they won by default :-)

But what you are saying is : this must be filled out with date and time it was dropped off, served and with who? And it was supposed to be done by the server at the time it was left with me?
