Yes, and that does sometimes occur.

Does that prevent the creditor from suing them again over the same debt? Would they just sell it to another debt buyer?

Depends on the judges ruling. In such cases they can rule "dismissed without prejudice" which means they can refile the suit at a later time, or they can rule "dismissed with prejudice" which bars them from suing again.

 

In the second instance they would almost certainly sell the debt to another JDB.
