My first dispute to the credit bureaus and it's a critical one

Dear All:

I had a BOA card that I fell behind in payments.  Equifax is reporting last activity date as Feb 2011 and Trans Union is reporting Jan 2014.  Equifax is reporting it as a 'charge off' and Trans Union is reporting it as "Payment after charge off/collection".

 

Equifax is reporting 90+ days late  27 times (Feb 2015, Jan 2015, Dec 2014, Nov 2014, Oct 2014, Sep 2014, Aug 2014, Jul 2014, Jun 2014, May 2014, Apr 2014, Mar 2014, Feb 2014, Jan 2014, Dec 2013, Nov 2013, Oct 2013, Sep 2013, Aug 2013, Jul 2013, Jun 2013, May 2013, Apr 2013, Mar 2013, Sep 2011, Aug 2011, Jul 2011)

 

Experian is reporting 90+ days 25 times (Feb 2015, Jan 2015, Dec 2014, Nov 2014, Oct 2014, Sep 2014, Aug 2014, Jul 2014, Jun 2014, May 2014, Apr 2014, Mar 2014, Feb 2014, Jan 2014, Dec 2013, Nov 2013, Oct 2013, Sep 2013, Aug 2013, Jul 2013, Jun 2013, May 2013, Apr 2013, Mar 2013, Feb 2013)

 

TransUnion is reporting 90+ days 0 times.

 

What are my first steps in disputing this?  What should  be the first things I dispute?  Is this something that can be entirely erased from my record?  Any suggestions would be very welcome and much,much appreciated!

I was trying to respond to your original reply on my post, but somehow it got deleted. So, I will just make this one short. First of all, when they reported that you were 90+ days late on Equifax those months in 2011 are they reporting OK those months on Experian?

The first thing to realize is that consistency between the CRAs is not required, and is not itself basis for a dispute.

A creditor can choose to report a given item to none, one, two, or all CRAs. 

The important thing is that what is reported by accurate not that each and every item be reported to each CRA.

 

In deciding if you have a dispute, look for items of information that are inaccurate, such as reporting a 90-late if the account was only delinquent at the 60-late level.

For each asserted inaccuracy, explain why the reporting is inaccurate, and how you want it corrected or whether it should be deleted.

I was thinking of writing the letter like this:

 

"Recently I obtained a copy of my Experian credit report and discovered an error.
I recognize that the Fair Credit Reporting Act demands any account information that is reported be reported accurately.
The following information is inaccurate and needs to be deleted from my credit report as soon as possible:

 

Bank Of America Credit Card
The last activity on this account is February 2011, not January 2014. 

The status of the account "paid account/was a charge-off" is correct; however it is still being reported as 25 times 90+ days late as recent as February 2015.

 

Thanks very much for helping me remove erroneous information from my report in a timely manner."

"Date of Last Activity" is not a stricly defined term and has no signifigant relevance in regards to reporting. It can mean anything from the last payment made, to the last time a bill was sent or a contact attempt was made, to the last time someone in the collections "looked" at your account. Verify your Date of First Default with the CRA's and make sure its the same across all three.

Is this a paid CO? If so, when was it paid?
