My rebuttle to GECRB, they are such liars!

This is my BBB rebuttle to GECRB. If something doesn't make sense please let me know. I want this to be as easy as possible for whoever reads it @ the BBB. Let me know what you guys think!

 

 

I disagree with the findings and I believe GECRB is intentionally trying to twist half-truths and is withholding crucial evidence which I will now bring to light proving their intent to defraud.

 

In paragraph 2 GECRB insists “GECRB has reported accurate, identical account information to each of the consumer credit agencies, Mr. Vuong expressed specific concerns regarding the charge-off date, a lack of payment history and reporting of the balance owed.”

 

In a phone conversation on October 4th 2013, a Ms. Blank Blank, Senior Specialist Corporate Consumer Relations from GECRB, openly admits the information being reported to Experian is incorrect. She attributes it to “an update we sent out March 2010 that never made it through”

 

In paragraph 3 GECRB insists “the account charged off as a loss on July 5, 2009 with a balance of $1,143.40. After charge-off, GECRB received payments which lowered the outstanding account balance. Each payment was returned unpaid by Mr. whitesol bank resulting in the payment to be reversed from the account and the outstanding balance to be reinstated at $1,143.40.”

 

I have never heard of this claim before, so I went to my local Wells Fargo and sat down with the Assistant Vice President/Branch Manager. After 3 hours we were able to conclude 2 things with absolute certainly. 1. No payment was ever attempted from July 2009 to June 2010 to GECRB and 2. No payment to any party has ever been returned unpaid from my account. I believe this is another tactic by GECRB to slander my name and I have 18 months of bank statements to prove it. Also very clearly shown on an Experian report I have supplied to GECRB dated July 19th 2013 a charge of month of December 2009; 5 months from actual charge off date and no listed date of first delinquency. As you know the FCRA mandates a credit reporting time period of no more than 7 years from date of first delinquency, is this case since it is not listed AND GECRB reported the charge off of 5 months later this will result in this account illegally being reported roughly 10-12 months longer than the FCRA allows.

 

 

In paragraph 4 GECRB insists “On March 20, 2010, the account was sold to Encore Capital. GECRB reported the PayPal™ Extras MasterCard® account to the consumer credit agencies on March 20, 2010 including the purchase of the account by another lender. In addition, the balance owed to GECRB was reduced to zero. “

It is very clearly stated on an Experian report I have supplied to GECRB dated July 19th 2013, under recent balance is listed “$1,143.40” The FCRA mandates that GECRB timely updates the credit reporting agencies to ensure current accuracy. In this particular case there is proof a span of roughly 39 months went by with GECRB knowingly providing inaccurate information.

 

 

In paragraph 5 GECRB insists “Mr. whitesol provided a copy of his credit report showing updates made in December 2009. GECRB reported accurate and truthful account information to the credit reporting agencies. GECRB is not involved in the integration of the information to a consumer's credit report.”

 

The report clearly states false information as of July 19th, 2013. GECRB has an obligation to ensure any reporting done is accurate and truthful. When I made light of the issues above with their reporting in July 2013 I was told multiple times by 4 different “senior specialists” it was correct when in fact it was blatantly false. Based on a “Universal Data Form” provided to myself by Ms. Blank Blank dated 10/14/2013 GECRB is only now trying to fix selected mistakes on record but not all the issues at hand.

 

In close GECRB made a mistake in their reporting, a mistake that stood for over 3 years, causing damage to my credit score and may of even caused me to be denied for credit or not receive the best terms. When brought to light to many “senior specialists” GECRB refuses to admit or correct blatantly inaccurate reporting. Only after pressing the issue for over 2 months, 10+ letters, 10+ emails, and over 20 hours of phone calls does GECRB respond trying to place blame on a failed update from over 3 1/2 years ago. The damage has already been done and GECRB must take responsibility for it.

 

I request that GECRB remove the entire account from any and all credit reports agencies with a bar on any future reporting of this account.
