My response to WF verification-too much info????

Dear Ms. XXXX:

 

Thank you for your letter dated October 8, 2014 concerning the above two accounts.  While I understand what you have stated in your letter, I have to respectfully disagree with the information that you have concerning these accounts.  I have been able to take a look at my most recent credit reports from Experian, Equifax and Transunion, as well as my Transunion credit reports dating back to 2010.  Based on the changes in the information reported on the Transunion reports, I believe that the balance due is $54.00, not $249.00 as you indicate.  Here is why:

 

Account ending in xxxx

  • July 2010 (TU ) shows a balance of $249.00 with the last payment reported as 4/30/10. The account was in charge off status at this point.
  • April 2011 (TU) shows a balance of $164.00 with the last payment reported as 1/2011.
  • August 2011 (TU) shows a balance of $114.00 with the last payment reported as 6/2011.
  • December 2011(TU) shows a balance of $54.00 with the last payment reported as 9/2011.
  • The TU reports continue to show a $54.00 balance and last payment reported as of 9/2011 until October 2013, when on January 3, 2014 the balance reports as $0 and the last payment reported as 9/2011. This account number no longer shows on my TU report as of September 2014.
  • September EX report shows balance as NR, past due amount of $54, charge off reported 11/11 to 11/13, except of 7/13 and 8/13 which show OK. I do not see anything on EX prior to 11/11.
  • October 2014 EQ report shows a $0 balance as well as the charge off status from 11/11 to 10/13. 8/13 and 9/13 show NR.

  • February 2014 (TU) reports shows the trade line as WFF PLL with a balance owed of $54.00 and last activity date of November 2013.
  • EX report of September 2014 reports a balance of $54, charge off reported 3/14, with nothing prior to 3/14. Also, I have a monitoring subscription due to one of the recent credit card breaches which alerted me that this was added to my EX report 9/12/2014 with a status date of 4/30/14 and the trade line named WFF Auto Finance.  I have never had an auto loan with Wells Fargo.
  • EQ report of September 2014 reports a balance of $54, past due amount of $54 and date of last activity of April 2010. Report also shows charge off status starting 12/13.

 

As you can see, based on the information above which is contained in my credit reports, there is quite a bit of inconsistent information.  Given the fact that my TU reports dating back to 2010 show a declining balance until December 2011, I believe that the amount I owed is $54.00.  You also mentioned in your letter that this account was transferred, yet I have never received any communication from you to that affect.  Had I received such communication, I would have made every effort to resolve this with you.  I was raised to pay back all my debts. 

 

Therefore, due to the inconsistency of the information in all of my reports I am asking for a goodwill gesture on the part of Wells Fargo to accept a certified payment of $54.00 to satisfy this account in full and to remove both accounts from all of my credit reports.  I understand that you do not have to do this; however, during the time that this account went into charge off status, I had to seek specialized mental health testing and treatment for my son, which was not covered by insurance.  Unfortunately, his diagnoses required treatment that at the time those specialists that did not participate with my insurance plan and we did not qualify for any other financial assistance and it was quite expensive.  I am thankful that my son seems to be doing much better, as now as an adult is getting his life in order.  Since that time, I have been able to get a handle on my finances and have worked hard to pay all my debt rather than to file bankruptcy. 

 

*****After looking at all of my reports that I could get my hands on, I don't think the right hand knows what the left is doing.  Thanks for looking and any advice you can give....this is the last unpaid charge off/collection on my report and I want to get this dealt with before I move on to the other baddies (PIF charge offs).

Seems okay to me.

Don't be surprised if they just accept your offer of $54.00 without accepting the delete from your credit reports.

I would go with it.

Mailed my response today as well as emailed it to all the Executive email addresses I could find online.  Guess we'll wait and see now.

Mixing of statements that dispute the accuracy of what has been verified, and particuarly what has been reported, with requests for their consideration of other items, such as a PFD offer or a settlement, can lead to problems.

 

If your credit report shows the balance that you are contesting, they may consider your letter as a direct dispute of the accuracy of their reporting, as opposed to a settement offer.  That is particualry true since your opening paragraph is all about disputing.

Are you asking for a decision on a dispute, or only their consideration of a settlement?

Is credit reprot deletion also an issue?

The intent is to get them to prove to me that I owe more than $54. Based on the letter I received back saying that I owe $249 with $54 past due...which has been showing past due on my reports for years...it doesn't seem that What they have is accurate given the account transferred from one WF family member To another WF family member. Even if I have to pay $54 and my reports show paid in full...I'm fine with that. If they can show me that I still owe $249 I will pay it. The letter and what they report don't jive. This is the last charge off that I have. I have paid everything else off in full..no settlements...no BK....I'm way past SOL so they can't sue me...I just want this cleared up.

Whether done by way of a DV request or a dispute, they are not required to provide documentation or "prove" the matter in order to verify.

Verification of either the debt in response to a DV, or of the accuracy of their reporting in response to a dispute, requires them to investigate and make a determination based on the results of that investigation.

 

In order to require the production of proofs and get a decision as to what it does or does not prove is a judicial process that is beyond the scope of the FDCPA or FCRA admin investigation processes.  Neither process has a judge empowered to compel evidence or make a decision, and thus evidence is not a compulsory part of the processes.

Agreed - the validation is merely going back to the OC and basically asking them "Do your numbers match up with what I have on this persons account?"
