I have a guestion for anyone that can answer. Capital One filed a judgement agaist me back in 2009 and from what the clerk told me yesterday - an officer of the law served me and the state of florida doesn't require signature. I don't remember getting served and when I pulled the public record up it states the wrong year of birth. However, everything else registers to me. I called all three credit bureau's and Equifax is the only one that deleted the judgement. The others told me that it belong to me even tho it has the wrong year of birth. I would appreciate any feed back

Well at this point im in the same boat as you are. I put in a dispute on this Judgment so we shall see what happened. I did call CapOne and from what they said, everything would have to mach up on their records... ssn, dob, name etc. And since one of these things matched, they told me to just dispute this and it should be removed..
I also want to mention that none of my wife's information matched what the Court had on their documents also.
I'm going to try and get ahold of a consumer atty and ask weather the credit bureau's have the authority to keep a judgment on a consumer report when the birth year isn't right. I just hope someone here can give me some feed back. Capital One which I think is a collection agencie made it look like they were the actual Captial One Bank. It's on the docket.

Yes I did. However, when I called Capital One and asked what was the balance she told me 5000.00 and forward my call some where else and 2nd person told me that it was 3000.00. I've read somewhere in this blog something about a Capital One collection.. Just not sure where I read it
Let me clarify myself, when I started this thread I was very upset as I knew 100% that this Judgment did not belong to my wife. My intention was to get advice as to what or anything I could do to fight back the credit agency's or Judicial system for reporting inaccurate information. Now to answer your post, the only thing that matched up was our address and all the alias that are listed on a credit report on my wife. I think most us would be shocked as to how many alias is on all our credit report.
In my case, I will (should ) 100% be able to have this removed. As it clearly states in the Court document the name don't match up. The only thing that the Court have correct is the address but does that give anyone confirmation this is the right person to file a Judgment on and report it on one's credit report??? I mean without verifying ssn, dob, etc...
