Need some serious help with collection

Hello all, I had a medical collection show up on my credit report last year for a hospital bill. The bill was covered by my insurance, but I still received a collection notice from First Source for $812. After requesting verification on the debt, I was sent a copy of a bill with what they said was the procedures I had performed. This bill did not match the medical records I received from the hospital. After comparing the two, I see that they billed my insurance for procedures that I did not have performed. After my insurance paid for more than what I had done, they then billed me for an additional $812. I contacted both the hospital and the collection agency (I also CC the states attorney, and the BBB) with what was going on. I finally got a response a month and a half later from the BBB saying they were removing this from my reports.

I check my reports everyday and I know this was removed before I received this response from the BBB. The problem is that they re added this to my EQ report. I just tried to call them, and spoke with a lady who wanted me to give her my social security number. I refused, so she didn't want to talk to me about my account. I finally verified enough information about myself and she told me she would transfer me to someone who could help me.

After being on hold for 15 minutes, I was told that I need to fax in the information to them showing that they were supposed to remove it, and that they re added it to my report because "we don't re add information". She also said that it could take 90 days to be removed from my report. I told her that I didn't want to fax anything, and asked if her information showed that it was being reported. All she would say to me is that if we said we were going to remove it we did.

After much arguing she finally told me to call another number. I did and was told that I wasn't verifying my information and that I needed to speak to a supervisor(which I already did) and that I was given very clear information on what I need to do.

I guess I don't know where to go from here. Do I have a leg to stand on here? I am so ticked at this point I want them to know they are screwing with the wrong person.

This is how it is reporting on EQ

The reply from the BBB is as follows:
Consumer's Original Complaint :
I have received a copy of a bill from this company for services in a hospital that I have never received. I have a copy from the hospital.
I have a copy of all services rendered from the hospital in question, I also have been provided a copy of a bill from First Source with a list of services that I did not receive. This bill is addressed from the hospital itself, which even shows what my insurance paid on. Yet the two items both "from" the hospital do not match. I know for a fact what was done testing wise at the hospital and the bill does not match that.

Consumer's Desired Resolution:
Removal of the collection from the 3 major credit bureaus.

Re: Need some serious help with collection

Aren't there rules when it comes to re-inserting negative information?

It's also possible it was a billing mistake by OC that can be resolved between them and your insurance company. If you definitely didn't have a lumbar puncture, I'd start with the hospital admistrator and ask for help with the matter. True, the admistrator might not be easily reached but that's someone the CA would politely respond to. Smiley Happy

Re: Need some serious help with collection

I really did not have a lumbar puncture, I am pretty sure I would remeber that Smiley Happy.  I have tried calling the hospital, they say that the account is no longer with them to contact the collection agency.  My biggest pet peeve at this point is that they re added this to my report.

Re: Need some serious help with collection

The FCRA only regulates the reinsertion of previously deleted information if the information was deleted based on a specific determination in a dispute that it was inaccurate or could not be verified.  If it was deleted voluntarily, or for any other reason, the CRA relies upon the accuracy of the reporting, and the furnisher does not have to provide any reason explaining the reinsertion.

If the information was deleted as a result of a prior dispute, then the furnisher must, upon requesting reinsertion, provide a Certfification of Accuracy to the CRA, the CRA must accept that Cerfitication prior to reinserting the information in consumer's credit file, and if they reinsert, the CRA must notify you of that fact within 5 business days.
