Hi everyone !
I am new to credit repairing, so sorry if it was answered already (I did used the search function)
I have 2 things that puzzled me on my pitiful Equifax report
Legal Item filed on Feb, 2007
Type Legal Item
Court number ********
Case number ********
Date filed Feb, 2007
Status date Jan, 2009
Date paid Jan, 2009
Amount $413
Plaintiff State OfNew York
Tax lien filed on Feb, 2007
Type Tax lien
Court number ********
Case number ********
Date filed Feb, 2007
Status date Jan, 2009
Date paid Jan, 2009
Amount $414
These two things seem to be the exact same thing. The only difference is the case number which is the same except for two 00 preceding the second one i.e. one is 2325, the other one 002325. What are your thoughts ? Looks like duplicates to me, how can I get rid of at least one ?
Tax lien filed on Oct, 2004
Type Tax lien
Court number ********
Case number ********
Date filed Oct, 2004
Status date May, 2005
Date paid May, 2005
Amount $631
My inexperienced-self called the CRA based on the fact that I am NY state resident and it should no longer be reported. But I was told that the 5 year reporting were for judgments, not Tax liens. Is this true ? Just want to double check.
Thanks in advance !!!
These do seem to be duplic information....
These next link might not apply to you, but please feel free to read them.
what i would do is possible dispute them as innacurate information .....
Common Abbreviations
Credit Scoring 101 - great for knowing what is in your credit score and to see how your score is impacted.
What Steps Do I Take - great for learning the repair process.
and Example letters - PFDs, GWs, DVs, etc.
I would dispute them online. I have one also and I sent a letter to ask to have it removed. Does anyone know what the chances are that it willbe deleted?
Thanks will try.
Does anyone know if the 5 year reporting applies to Tax lien too in NY ?
Thanks again, this forum is addictive
If these do, in fact, represent the same tax debt, not only do they appear duplicative, but they are contradictory.
The dates of filing are different. More importantly, the date paid, which controls the FCRA exclusion date, is different.
In addition to asserting duplicate reporting, I would also assert that one or the other is necessarily inaccurate in the facts.
The CRA needs a CR exclsuion date. Which one are they using?
I apologize if I wasn't clear. The first two are the ones that are duplicates and have the same date of filing and paid.
The third one, I was trying to have it deleted based on the 5 year NYS rule, but it didn't work (at least over the phone).
I don't see any CR exclusion date.
Write the CRA and ask them for the reported date of record of payment of the lien. That controls CR exclusion.
Such requests are made under FCRA 609(a)(1), and require the payment of a CRA processing fee of $11.00. Add 7 years to the date of payment, and you have the legal CR exclusion date.

Paid Tax liens are 7 years, paid judgments are 5 years. You can find this under the NYS Fair Credit Report Act Section 380-J Prohibited Information
Too bad, I was hoping if paid in NY State, it would be 5 year. You live, you learn
Thanks again to everyone.
Discouraged as I have a looooong way to go, before I get a clean report. But, At least, I am on my way, there is hope
