No response to verification letters in 30 days..now what??

Sent out verification letters to 6 collection agencies and only one responded that it could not be verified, the other 5 did not respond.  What is my next step?  Does anyone have a sample letter for follow up? not sure what to do next since they did not respond.  Any help would be appreciated.

The DV process under FDCPA 809(b) does have any provision that compels the debt collector to validate the debt within any period of time.  It compels the cessation of debt collection activities on their part, but does not compel validation.  Texas has a state augmentation of the federal FDCPA that does compel response witin 30-days, but unless you are a resident of Texas, you have only the federal FDCPA to govern compliance with the DV process.

 

If they resume any debt collection activities prior to providing validation, then they would be in violation of FDCAP 809(b).  Until such occurance, they can decide when or if to provide any validation in exchange for loss of their ability to actively continue their collection of the debt.
