I am going to send a PFD to a collection agency who has not provided a dunning notice but they have initiated contact on the phone, and the original creditor is willing to accept payment.
Should I state if the collection agency does not cooperate with my PFD that I will continue with my report to the FTC, and will pay what is due to the original creditor instead?
Do you think this will help or hinder my PFD?
If the OC is willing to accept payment, perhaps they will also be willing to contact their agent, who has violated their statutory obligation during their representation of the OC, and "persuade" them to delete?
Being as the OC is their gravy train, that might have more impact than an FTC slap on the wrist.
I like your thinking.... I just wonder how seriously many debt collectors take FTC nasty-grams, knowing that the FTC does not actually take legal action on individual consumer complaints.
