PFD Recourse

Assuming a pfd is accepted, and you pay the agreed amount, what recourse do you have if the creditor does not delete? Would providing acceptance letter and proof of payment to the CRAs get it done, or is it still entirely up to the creditor?

What I'm asking is after paying and giving it 45 days, then throwing in a few reminders to the creditor and it's still not done, what's your next course of action?

Thanks!

Re: PFD Recourse

This is where that written agreement comes in writing. If they agree to deletion in exchange for whatever amount you pay them, that is an agreement that they need to honor. If they do not, you can begin using the CRA's, BBB, and any other means to ensure they are holding up their end of the bargain.

Re: PFD Recourse

Good advice, thank you.

At the end of the day, would the CRAs remove it themselves when presented with the agreement and proof of payment with no action on the creditor's part?

Re: PFD Recourse

Probably not, they are interested in reporting accurate information. The accurate information would be that the collection has been paid and the collection should reflect that in the reporting.

Re: PFD Recourse

Well the reason I'm asking is I'm considering a pfd with a...shall we say...a shady payday loan company with so many BBB complaints that I doubt very seriously they'd care if they had one more. So if I had no actual recourse I may end up wasting money I could've paid another acct with. Chancy.
