Can a paid (medical) judgment be vacated in Maryland? If so, how can I pursue this? The judgment shows up in the Maryland Case Search as satisfied in 4/2017. My google searches have been unsuccessful.
Was the judgment rendered by a federal court or a Maryland state court?
Federal judgments are governed by Federal Rules of Civil Procedure.
Rule 60 of the FRCP provides for vacature based both on error in the judgment and equitable relief, such as after satisfaction of the judgment.
While some state courts are provided with similar vacature discretion based on grant of relief after satisfaction of a judgment, I dont believe the Maryland Rules of Civil Procedure provide that discretion. Pertinent rules 2-534 and 2-535 limit such review of judgments, and dont provide for equitable relief based simply upon satisfaction of the judgment.
I recommend consultation with a member of th Md bar for interpretation of the Md rules of civil procedure.
Thanks!
